
Following the Supreme Court's directions, the Ministry of Information and Broadcasting (MIB) has mandated a "self declaration" certificate for all new advertisements starting June 18. The Ministry announced that a new feature has been added to the Broadcast Seva Portal to facilitate the submission of these certificates for TV and radio ads. For print and digital ads, the declaration, signed by an authorized representative of the advertiser, must be submitted on the Press Council of India’s portal.
According to the Supreme Court's orders dated May 7, self-declaration certificates will be mandatory for all new advertisements from June 18. However, an additional two-week buffer period has been provided to allow ad agencies to become familiar with the new requirements. The portal became operational on June 4.
The MIB stated that all advertisers and advertising agencies must obtain the self-declaration certificate for any new advertisements issued, broadcast, aired, or published on or after June 18, 2024. The buffer period is intended to give all stakeholders adequate time to adjust to the self-certification process.
Currently, ongoing advertisements do not need self-certification. The mandatory declaration requires advertisers to certify that their ads do not contain "misleading claims" and comply with all relevant regulatory guidelines. Agencies must also submit "proof of uploading" the certificate to the relevant publisher for record-keeping purposes.
